LEGAL NOTICE TRUSTEE'S SALE OF REAL ESTATE LOVINGSTON MAGISTERIAL DISTRICT, NELSON COUNTY, VIRGINIA In execution of a Deed of Trust from Robert L. Canody, II and Laura L. Canody, husband and wife, dated September 28, 2010, of record in the Nelson County Circuit Court Clerk's Office as Instrument 100002494, the undersigned sole acting Substitute Trustee, having been substituted by an instrument recorded as Instrument 190001430, will offer for sale at public auction the following real estate: All those certain tracts or parcels of land, together with all buildings, fixtures and Improvements thereon and rights, privileges and appurtenances thereunto belonging, lying in Lovingston Magisterial District of Nelson County, Virginia, in Lake View Hills Subdivision, being more particularly described as follows: Parcel 1, Tract A - All that certain lot or land containing 0.63 of an acre, more or less, designated as Lot 6B on a plat entitled "Lots 6A and 6B, Division of Original Lot No. 6, Lake View Hills," made by Tom Shumate, surveyor, dated August 27, 1982, together with access thereto over original Lot No. 7 as shown on the original plat of Lake View Hills, which plat is recorded in the Clerk's Office of the Circuit Court of Nelson County, Virginia, in Plat Book 2, page 44, and also with access over original Lot No. 4 as shown on said plat. PARCEL L, Tract B - All that certain lot containing 0.44 of an acre, more or less, adjoining Lot No. 6B above described on the north side and being original Lot No. 7 in the subdivision of Lake View Hills made by T. W. Saunders, S.N.C., dated April, 1948, recorded in said Clerk's Office in Plat Book 2, page 44, but this conveyance is subject to the rights of way as shown on a certain plat recorded in Deed Book 199, page 120. Parcel II - All that certain lot or parcel of land containing 0.53 of an acre, more or less, being the residue of Lot No. 4 In said subdivision originally containing 0.6 of an acre, as shown on a plat of survey dated April 1948, made by T.W. Saunders, S.N.C., a copy of which plat is recorded in the aforesaid Clerk's office in Plat Book 2, page 44, after deducting that certain strip of land 20' wide x 150' long, bounded on the west by Lot No. 5, on the north by Lot No. 4 and on the south by State Route 745, which strip was retained by P.D. Payne, Jr., in a certain deed dated February 27, 1963, to Ervin M. Carter, et ux, of record in the aforesaid Clerk's Office in Deed Book 99, page 229. Being the same property conveyed unto the Grantors herein by deed dated September 20, 2010 from James A. Wood, Jr., et ux and recorded contemporaneously herewith. This conveyance is subject to all easements, covenants and restrictions of record constituting constructive notice thereof and legally binding thereon. The sale will be held in front of the Nelson County Court House at 84 Courthouse Square, Lovingston, Virginia, on FRIDAY, NOVEMBER 1, 2019 AT 12:00 NOON TERMS: Cash. A deposit of Ten Percent (10%) of the sale price will be required from the successful bidder at the time of the sale, and the balance will be due within Fourteen (14) days after the sale date. The property will be sold "as is" "where is". Possession will be the responsibility of the successful bidder. The property will be conveyed to the purchaser by special warranty deed. Real estate taxes for the year 2019 will be prorated as of the sale date. The successful bidder will be required to execute a Memorandum of Trustee's Sale which will be read prior to the sale and may contain additional terms. The successful bidder will be responsible for all costs and fees related to the recording of the Substitute Trustee's Deed, including the Grantor's tax and the cost of the deed prepared by the Substitute Trustee's attorney.
