The mother of a man who died following an incident at the Jamerson Branch of the YMCA swimming pool in late May has filed a wrongful death lawsuit against the Lynchburg organization.
The suit, filed in September in Lynchburg Circuit Court on behalf of Remedios Duffy, alleges that a lifeguard on duty was “not diligently and properly patrolling swimmers for signs of peril” on May 29, the day her son, Richard Kenneth Duffy, Jr., became distressed in the water and fell underneath the surface for six minutes. Duffy, unresponsive when pulled from the pool, died on June 1 at age 39 at Lynchburg GeneralHospital after he was on life support for a few days.
